Welcome to GovSkills Academy (“we,” “us,” “our,” or the “Academy”). These Terms and Conditions (“Terms”) govern your access to and use of the GovSkills Academy website, digital learning platform, course materials, downloadable resources, and associated services (collectively, the “Platform”).
By browsing the website, registering for an account, purchasing a course, or accessing any digital content, you (“User,” “Learner,” “Client,” or “Municipality”) agree to be bound by these Terms. If you do not agree to all the terms and conditions set forth herein, you must immediately cease using the Platform.
In compliance with Section 43(1) of the Electronic Communications and Transactions Act No. 25 of 2002 (ECTA), GovSkills Academy makes the following information permanently available to its users:

Core Business: The provision of digital training, capacity building, and educational programmes for the public sector.
We reserve the right, at our sole discretion, to modify, amend, or replace these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review this page periodically.
To ensure clarity, the following terms shall have the designated meanings throughout this document:
“Account” means the secure digital profile created by a User to access the Learning Management System (LMS).
“Course Content” encompasses all proprietary educational materials, including but not limited to video lectures, PDF frameworks, slide decks, interactive quizzes, case studies, and text lessons provided by GovSkills Academy.
“Intellectual Property” refers to all copyrights, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered) in and on the Platform and Course Content.
“Institutional Client” refers to a municipality, government department, development agency, or juristic person that procures bulk training for its employees.
“Learner” refers to the individual natural person who is registered to undertake a course on the Platform.
To enrol in a GovSkills Academy programme, you must register for an Account. You agree to provide accurate, current, and complete information during the registration process. Providing false or misleading information, particularly regarding your identity or municipal affiliation, may result in the immediate termination of your Account and the revocation of any issued certificates.
You are solely responsible for safeguarding your login credentials (username and password). You agree not to disclose your password to any third party. GovSkills Academy cannot and will not be liable for any loss or damage arising from your failure to protect your login information.
Under no circumstances may an Account be shared between multiple individuals. Each enrolment grants a single, non-transferable licence to one specific Learner. Our Platform employs concurrent login detection and IP tracking algorithms. If we detect that an Account is being used by multiple individuals, or if login credentials have been distributed across a municipal department to bypass enrolment fees, GovSkills Academy reserves the right to suspend the Account immediately, without prior notice or refund, and may pursue legal action for theft of intellectual property.
The value of GovSkills Academy lies in our highly specialised, expertly developed Course Content. We fiercely protect our intellectual property.
All Course Content, software, interface design, text, graphics, logos, images, and audio-visual materials on the Platform are the exclusive property of GovSkills Academy or its licensors and are protected by the Copyright Act No. 98 of 1978 of South Africa and international intellectual property laws.
Upon payment of the requisite enrolment fee, GovSkills Academy grants you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and view the Course Content solely for your own personal, non-commercial, educational purposes.
You explicitly agree that you will not:
Download, record, rip, or otherwise capture any proprietary video lessons or audio streams.
Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform or Course Content for commercial gain or internal departmental distribution without our express written consent.
Remove any copyright, trademark, or other proprietary notices from the Course Content or downloadable resources.
Use data mining, robots, screen scrapers, or similar data gathering and extraction tools on the Platform.
Distribute our proprietary policy templates or municipal frameworks to external entities or publish them on public forums.
Violation of these intellectual property provisions will result in immediate Account termination, forfeiture of all fees paid, and the initiation of civil proceedings to recover damages.
When purchasing a course as an individual Learner, your access to the Course Content is granted immediately upon the successful clearing of your payment through our designated payment gateway.
When an Institutional Client procures training for a cohort of officials via a Purchase Order (PO), access to the Platform is provisioned manually by our administrative team. The Institutional Client must provide accurate Learner rosters. Once login credentials have been issued to the designated Learners, the transaction is considered fulfilled.
Unless otherwise specified on the specific course sales page or within a Service Level Agreement (SLA), Learners are granted a standard access period of twelve (12) months from the date of enrolment to complete the course and download their certificate. After this period, GovSkills Academy reserves the right to archive the Learner’s progress and revoke access to the active course materials to ensure server efficiency. Extensions may be granted upon written request at the Academy’s discretion.
GovSkills Academy is committed to ensuring our training aligns with current South African legislation and municipal best practices. Therefore, we reserve the right to update, modify, add, or remove modules, video lessons, and reading materials from any course at any time without prior notice.
All prices listed on the Platform are in South African Rand (ZAR). We reserve the right to adjust the pricing of our courses at any time; however, price changes will not affect enrolments that have already been processed and paid in full.
For individual purchases, GovSkills Academy utilises secure, third-party payment gateways (such as PayFast or Yoco) to process credit card, debit card, and Instant EFT transactions. We do not store your raw banking details or credit card numbers on our servers. You agree to adhere to the terms and conditions of these third-party payment processors when concluding a transaction.
For municipalities and government agencies paying via invoice and Purchase Order, standard payment terms are strictly thirty (30) days from the date of invoice generation, in accordance with the Municipal Finance Management Act (MFMA) guidelines, unless a specific SLA dictates otherwise.
Late Payments: Failure to settle an invoice within the stipulated timeframe may result in the suspension of Platform access for the entire municipal cohort until the outstanding balance is cleared.
Interest: GovSkills Academy reserves the right to charge statutory interest on overdue institutional accounts.
GovSkills Academy certificates represent a standard of excellence and municipal competence. We maintain strict rules regarding academic integrity.
To successfully complete a programme and earn a certificate, Learners must complete all required modules and achieve the minimum pass mark (as specified in the course syllabus) on all quizzes, assignments, and final assessments.
Learners must submit their own original work for any open-ended assignments or case studies. The following constitutes academic misconduct:
Plagiarising text from external sources or other Learners.
Using artificial intelligence (AI) tools to generate answers for subjective case study submissions, unless explicitly permitted in the assignment brief.
Having another individual complete the course modules or quizzes on your behalf. If GovSkills Academy discovers evidence of academic misconduct, the Learner’s assessments will be invalidated, the certificate will be revoked, and the Learner’s municipal employer may be notified.
Upon successful completion, a digital, verifiable certificate will be generated automatically. GovSkills Academy maintains a secure digital ledger of all issued certificates. We reserve the right to confirm the validity of a Learner’s certificate to any third party (such as a prospective employer or municipal HR department) upon request.
All policies regarding the statutory cooling-off period, digital content consumption exemptions, and the procedures for requesting a refund or a Learner substitution are governed strictly by our Refund and Returns Policy. By accepting these Terms and Conditions, you explicitly acknowledge that you have read, understood, and agreed to the stipulations outlined in the Refund and Returns Policy, which is incorporated herein by reference.
GovSkills Academy provides educational resources designed to enhance municipal capacity. However, we do not warrant or guarantee that completion of our courses will result in employment, promotion, salary increases, or successful government tender applications. The application of the knowledge gained is entirely at the Learner’s discretion.
The policy templates, legal frameworks, and compliance guidelines provided within our courses are for educational and informational purposes only. They do not constitute formal legal, financial, or auditing advice. Municipalities must consult with their own legal counsel or internal auditors before implementing any operational changes based on our course materials.
The Platform and Course Content are provided on an “as is” and “as available” basis. While we strive for technical perfection, we do not warrant that the Platform will be uninterrupted, error-free, virus-free, or entirely secure. We are not liable for any data loss, dropped quiz connections, or server downtime caused by external hosting providers or national grid failures (e.g., loadshedding).
To the maximum extent permitted by South African law, including the Consumer Protection Act, GovSkills Academy, its directors, employees, facilitators, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or interruption of municipal service delivery, arising from your use of or inability to use the Platform. In no event shall GovSkills Academy’s total liability to you for all damages, losses, and causes of action exceed the total amount paid by you (or your employer) for the specific course giving rise to the claim.
The Platform may contain links to third-party websites, government portals, or external legislation databases that are not owned or controlled by GovSkills Academy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that GovSkills Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of such external resources.
You may stop using the Platform at any time. If you wish to permanently delete your Account, you may submit a request to our support team, subject to the data retention obligations outlined in our Privacy Policy.
We may suspend or terminate your Account, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the Platform and access any Course Content will cease immediately.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
You agree that any legal action or dispute arising out of or relating to these Terms, the Platform, or the Course Content shall be resolved exclusively within the jurisdiction of the competent courts of South Africa.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
These Terms, together with our Privacy Policy, Refund and Returns Policy, and any specific Service Level Agreement (SLA) entered into with an Institutional Client, constitute the entire agreement between you and GovSkills Academy regarding your use of the Platform, superseding any prior agreements, oral or written.
